EQUIPMENT RENTAL AGREEMENT
Star City Equipment Rentals • El Paso, Texas • (480) 246-9783
1. PARTIES AND RENTAL SCHEDULE
The rental provider identified in the final quote ("Star City") rents the identified equipment to the customer or business identified in that quote ("Renter"). The booking schedule, equipment description, approved attachments, job-site address, pickup/delivery arrangements, itemized final charges, refundable security deposit if any, and return date/time shown with this agreement are part of this agreement. No equipment substitution, added charge, or changed term is binding without the parties' agreement. Star City must identify its full legal contracting name in the final quote before this agreement is signed.
2. CONFIRMATION, PAYMENT, AND DURATION
An inquiry or rental request alone does not reserve equipment. Star City's approval, a completed agreement, and satisfaction of the payment and deposit terms in the final quote are required before release. Advertised prices are estimates until the final quote is accepted. Daily, weekly, and four-week rates apply only as specified in that quote. Any included operating hours, overtime rates, fuel charges, cleaning charges, cancellation charges, and late-return rates must be specifically disclosed in the final quote before signing; no unspecified flat fee or penalty is created by this agreement. A refundable deposit is separate from the rental price and is not a damage waiver or insurance. Any deposit deductions must be itemized and supported; the remaining deposit will be returned without unreasonable delay after inspection and reconciliation.
3. PICKUP AND DELIVERY
Delivery requests require at least the number of calendar days' advance notice shown in the booking policy. Delivery is subject to Star City's confirmation of routing, access, a safe unloading area, and the disclosed delivery fee. Renter must provide accurate site details, an available contact, and lawful access. Pickup transport must have appropriate capacity, securement, and legal compliance. Renter must not load, transport, or unload equipment without the necessary qualifications and suitable equipment. Changes to the confirmed delivery or collection window require agreement. Renter is not responsible for added rental time caused solely by Star City's delayed collection after an agreed on-time ready-for-pickup notice.
4. INSPECTION AND HANDOVER
The parties should document equipment condition, serial/asset identification, attachments, fuel or charge level, operating-hour meter, and visible damage at release and return. Renter should inspect the equipment and report visible defects before use. Hidden defects must be reported promptly when discovered. Renter must stop using equipment that appears defective or unsafe. Star City must not release equipment it knows is unsafe. Receipt of equipment does not waive rights concerning hidden defects, applicable warranties, or nonconforming delivery.
5. AUTHORIZED AND SAFE USE
Only competent, appropriately trained and authorized operators may use the equipment. Renter must follow the manufacturer's instructions, equipment limitations, applicable safety requirements, and required protective measures. No operation while impaired, unlawful use, overloading, unauthorized modification, disabling safety devices, subleasing, or unauthorized relocation is permitted. Renter is responsible for site conditions, required permits and utility-location arrangements, and keeping people clear of operating equipment. Equipment is not to be used for a purpose it is not designed to perform. Star City can explain controls but does not certify an operator's qualifications by renting equipment.
6. CARE, BREAKDOWN, AND INCIDENTS
Renter must perform normal operator checks described by the manufacturer and protect equipment from theft and avoidable damage. No repairs or alterations without Star City's authorization, except immediate reasonable steps needed to prevent injury or further loss. For a malfunction, stop operation, secure the area, and contact Star City. Report theft, injury, damage, or an accident promptly; contact emergency services when appropriate. Charges and any fair adjustment for unusable time will be addressed based on the cause and the parties' agreed terms and applicable law.
7. LOSS AND DAMAGE
Renter is responsible for reasonable, documented loss or physical damage to the extent caused by Renter's or its authorized operators' negligence, misuse, unauthorized use, or breach of this agreement. Ordinary wear, pre-existing damage, manufacturing defects, and damage caused by Star City's negligence are excluded. Repair charges must reflect reasonable repair costs; any claim for total loss must account for the equipment's actual condition and value rather than an automatic new-replacement amount. Any loss-of-use claim must be legally recoverable, reasonable, supported, and avoid duplicate recovery. This agreement does not release Star City from its own negligence, impose an unlimited indemnity, or waive nonwaivable consumer rights. Any separately required insurance must be described in the final quote; this rental does not provide insurance by itself.
8. RETURNS, EXTENSIONS, AND CANCELLATIONS
Return or make equipment ready for agreed collection at the place and time stated in the final quote, with the agreed fuel/charge level, attachments, keys, and reasonable cleanliness. Obtain confirmation before extending the rental; extensions depend on availability and an agreed price. Tell Star City promptly if a delay is expected. Cancellation, weather, rescheduling, late return, fuel, and cleaning charges apply only if stated in the accepted final quote and permitted by law. If no such fee is stated, this agreement does not invent one. Star City will discuss a reasonable resolution when equipment cannot be supplied or is unusable for reasons attributable to Star City.
9. DEFAULT AND EQUIPMENT RECOVERY
For a material breach, Star City may require use to stop and request lawful return, with notice and an opportunity to cure when appropriate or required. Any equipment recovery must be lawful and must not involve a breach of the peace. Nothing permits unsafe entry, trespass, or unlawful collection activity.
10. ELECTRONIC SIGNATURES AND COPIES
The signer affirmatively agrees to use an electronic record and typed-name signature for this rental and intends that signature to show acceptance of the displayed agreement and final quote. The signer confirms authority to bind the identified Renter. Before signing, the signer may review and print or save the complete record. After signing, a copy remains available in the rental account. Renter may request a paper signing alternative by calling (480) 246-9783 before signing. Withdrawing consent before signing will stop electronic signing but does not by itself cancel a separately confirmed obligation. The system records the signing account, typed name, date/time, agreement version, accepted quote snapshot, and document fingerprint. Those records support attribution; they are not a guarantee against identity misuse.
11. ENTIRE AGREEMENT AND APPLICABLE LAW
This agreement, the accepted final quote, and any mutually accepted written amendments are the rental terms. If there is a conflict, a specific mutually accepted quote term controls only for the matter it expressly addresses, subject to applicable law. Texas law applies, together with any applicable federal law. Nothing limits nonwaivable rights or requires a consumer to give up a legally available forum. If a provision cannot be enforced, the remaining provisions remain effective to the extent permitted by law. Changes after signature require a separate documented agreement and cannot silently replace the signed record.
